Khayr CRM is operated by Khayr K Ltd("Khayr", "we", "our", or "us").

Khayr CRM provides cloud-based software to assist charities and nonprofit organisations with fundraising, donor management, communications, reporting, campaign management, and related administrative functions.

Khayr CRM is a software platform. We are not a bank, payment institution, or financial institution, and we do not hold or receive charitable donations on behalf of organisations using our platform.

Our Services are intended for:

• Registered charities
• Charitable organisations
• Community organisations
• Non-profit organisations
• Other organisations approved by Khayr

You must have authority to act on behalf of your organisation before creating an account. You must be at least 18 years old.

You are responsible for:

• maintaining accurate account information;
• protecting your login credentials;
• ensuring only authorised individuals access your account;
• promptly notifying us of any suspected unauthorised access.

You remain responsible for all activity carried out using your account.

Khayr CRM may include features such as:

• Donor CRM
• Campaign management
• Donation management
• Gift Aid administration
• Reporting and analytics
• Email communications
• Fundraising tools
• Secure integrations with supported third-party services

We may add, improve, modify or remove features from time to time in order to improve the platform.

Certain Services integrate with third-party providers. Examples may include:

• Stripe
• Email providers
• Cloud hosting providers
• Analytics providers
• Accounting integrations

These services remain governed by the terms and privacy policies of the relevant third parties. Khayr is not responsible for services provided by third-party providers.

Where payment functionality is enabled, charities may connect their own payment processing account using supported payment providers.

Khayr CRM facilitates these integrations but does not receive, hold or control donor funds. Payment transactions are processed by the connected payment provider in accordance with that provider's own terms and conditions.

You agree not to:

• use the Services unlawfully;
• upload malicious software;
• interfere with platform security;
• attempt unauthorised access;
• infringe intellectual property rights;
• upload offensive, unlawful or fraudulent content;
• misuse donor information;
• attempt to reverse engineer the platform.

We reserve the right to suspend or terminate accounts engaged in prohibited activity.

You retain ownership of all information you upload to Khayr CRM.

By using the Services, you grant Khayr permission to process your data solely for the purpose of providing the Services. We process personal information in accordance with our Privacy Policy.

All software, branding, designs, graphics, content and technology forming part of Khayr CRM remain the property of Khayr K Ltd or its licensors.

Nothing in these Terms transfers ownership of our intellectual property. You may not copy, distribute, modify or reproduce any part of the platform without our written permission.

We aim to provide a reliable and secure service. However, we do not guarantee uninterrupted availability.

From time to time we may perform:

• maintenance
• upgrades
• security updates
• infrastructure improvements

Temporary interruptions may occur.

We take reasonable technical and organisational measures to protect the security of the platform and customer information. However, no internet-based service can guarantee absolute security.

Users are responsible for maintaining secure passwords and appropriate internal access controls.

Some Services may require payment. Where applicable:

• pricing will be communicated before purchase;
• subscription charges are payable in accordance with your selected plan;
• fees may change upon reasonable notice.

Failure to pay applicable fees may result in suspension of paid Services.

We may suspend or terminate access where:

• these Terms are breached;
• unlawful activity is suspected;
• continued access presents a security risk;
• required by law.

You may stop using the Services at any time. Termination does not remove any outstanding payment obligations.

Khayr CRM is provided on an "as available" basis.

While we make reasonable efforts to maintain accurate and reliable Services, we do not warrant that:

• the platform will always be uninterrupted;
• every feature will be error-free;
• every integration will always be available.

Nothing in these Terms excludes liability that cannot legally be excluded under English law.

To the maximum extent permitted by law, Khayr shall not be liable for:

• indirect losses;
• consequential losses;
• loss of profits;
• loss of fundraising opportunities;
• loss of goodwill;
• business interruption;
• loss of data resulting from circumstances outside our reasonable control.

Our total liability arising from your use of the Services shall not exceed the total subscription fees paid to Khayr during the twelve months immediately preceding the event giving rise to the claim.

Khayr shall not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to:

• natural disasters;
• power failures;
• internet outages;
• cyber attacks;
• government action;
• industrial disputes.

We may update these Terms from time to time.

Material changes will be published on this website. Continued use of the Services after updated Terms become effective constitutes acceptance of those changes.

These Terms are governed by the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
